Sounds like restraint of trade and since there arent any other premier rugby league competitions in Aus and NZ, I'm not sure the courts will like that.
I dont think restraint of trade would apply here they arent placing any legal restrictions on them playing for any other comp. Your employer is not required to hire you back after you quit.

Also its a union comp? They would say go play super rugby

Ohh theres another top tier Rugby League competition they can go and play for?

Your previous employer cannot legally prevent you from working, its why restraint of trade clauses are getting tossed out of courts left right and center.

The ban announced isn't a typical restraint of trade clause. Restraints of trade tend to be contractual restrictions on an employee working for other employers during/after their employment, which is why they are often challenged in the courts (as they risk preventing people earning a living outside of their current employment). It sounds like what the ARLC have announced is that if you sign with R360 or similar unsanctioned competitions, they won't re-hire / work with you for 10 years. Still potentially a form of restraint of trade in that it takes an employer (or, in the case of an agent, a meal-ticket) off the table - but it would be interesting to see whether a court would be willing to put a fetter on the contractual freedom of a business / organisation that has decided it doesn't want to engage with a particular pool of people. I don't think the ARLC would have announced such ban - a pretty strong response - without getting clear AU / NZ employment (and contractual) law advice.

Kind of agree. They are claiming R360 isn’t a sanctioned sport is unsanctioned by any creditable sporting body therefore illegal, a rip off, a counterfeit and unauthorised, to justify the ban.

And it’s kind of right, just like a pirate they are stealing the best without contributing to the development of the players, sport. The NRL could double all players pay and cease all development, defund the pathways, NSW cup, jersey Flegg, etc but as a legitimate sporting body, it must do all these things that an unsanctioned code, cutting corners doesn’t do.

I think the ban is justified and would stand up to legal scrutiny in that R360 is unsanctioned.
