She's says she's being held in limbo on her tax residency status and until that's sorted out she doesn't want to invest more money into NZ including providing venture capital to start ups and money for Innovation at Akl Uni for green tech. projects thru the CIE. Heaven forbid we allow people into the country who want to fund environmental projects and UN based green projects worldwide!!!!


Let's scrap a scheme which has brought already brought more investment money into the country than it's predecessor which had been going years longer and has another $2.2 billion in the pipeline.

It's not the tax law she has an issue with.... it's the time it's taking the IRD to recognise her commitment to NZ and the fact that she is expected to pay tax in NZ for income generated in another country and for which she's already paid tax. As an AIP, they have four years of residency in NZ before they become a tax resident, but the IRD are trying to use the PPOA to reduce that. PPOA is intended to be used to decide the main residence of tax residents.... not AIP's. The Revenue Minister, in the article you linked to, said that it been applied to broadly as it's supposed to decide the status of those who already are tax residents.... not make those who aren't one sooner.

The issue is that we have Double Tax Agreements with other countries meaning that only NZ based income should be taxed here while income generated in other countries is taxed there.... i.e. you earn your income in the US and you pay tax on that income here and shouldn't also have to pay tax on it again. The way the IRD is using the PPOA requirements is to get them to pay tax not only in the country it is earned but also in NZ. That's why she says it's punitive.... and, IMO, she's right.... paying tax on income which you earned in another country and already paid tax on, is punitive. A number of AIP's class applicants aren't investing more than the minimum in NZ because they're concerned as to how the IRD is applying the PPOA requirements on them.

Further to that, it's the US system that is punitive. All US citizens have to declare their global income, regardless of where it is earned and whether it has already paid tax. It's one way they ensure full visibility and repatriation of money back to the mother ship.

NZ, and almost every other jurisdiction, only requires taxpayers to declare their locally-earned income and untaxed foreign income.

So I can understand why any US citizen would want to do a bit of DD and ensure they aren't caught by two nets. Plenty of expat US citizens review how "permanent" their emigration is, every time they need to file their US returns, and have to work out how important that citizenship is to them. A pretty handy passport though
